Welcome to Dos Bros Construction. These Terms and Conditions govern your use of our website (www.dosbrosconstruction.com) and the services provided by Dos Bros Construction. Please read them carefully before using our website or engaging our services.

 

1. Acceptance of Terms

By accessing or using the Dos Bros Construction website (www.dosbrosconstruction.com) or engaging our services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our website or services.

 

2. Company Information

Dos Bros Construction is a family-owned and operated construction company serving Northern Colorado, including but not limited to Greeley, Fort Collins, Windsor, Eaton, Severance, LaSalle, Platteville, Evans, Johnstown, Milliken, Mead, and Longmont.

3. Services

Dos Bros Construction offers a range of construction services including, but not limited to: residential and commercial remodels, new construction, commercial construction, basement finishes, multi-family construction, tile and marble installation, waterproofing and preparation, and tub and surround installation. All services are subject to availability and may vary based on project scope, location, and scheduling.

 

4. Estimates and Proposals

All estimates and proposals provided by Dos Bros Construction are based on information available at the time of assessment and are subject to change. Estimates are valid for thirty (30) days from the date of issuance unless otherwise stated in writing. Final project costs may vary due to unforeseen conditions, changes in material costs, or modifications requested by the client.

A written contract or agreement will be provided for all projects prior to commencement of work. No work will begin until both parties have signed the applicable agreement and any required deposits have been received.

 

5. Payment Terms

Payment schedules will be outlined in the project contract. Dos Bros Construction reserves the right to require a deposit before work begins. Progress payments may be required at specified milestones throughout the project. Final payment is due upon completion of the project unless otherwise agreed upon in writing.

 

Late payments may be subject to a finance charge of one and one-half percent (1.5%) per month on unpaid balances, or the maximum rate permitted by Colorado law, whichever is less. The client is responsible for all costs of collection, including reasonable attorney’s fees, in the event of non-payment.

 

6. Project Timeline and Delays

Dos Bros Construction will make every reasonable effort to complete projects within the agreed-upon timeline. However, project timelines are estimates and may be affected by factors beyond our control, including but not limited to: weather conditions, material availability and supply chain disruptions, permit and inspection delays, changes or additions requested by the client, unforeseen site conditions, and acts of God or force majeure events.

 

Dos Bros Construction will communicate any anticipated delays to the client as soon as reasonably possible. We shall not be held liable for damages resulting from delays caused by factors outside our reasonable control.

 

7. Change Orders

Any changes to the original scope of work must be documented in a written change order signed by both the client and Dos Bros Construction. Change orders may affect the project timeline and total cost. Work on changes will not proceed until the change order has been approved and signed by both parties.

 

8. Permits and Inspections

Unless otherwise specified in the project contract, Dos Bros Construction will obtain all necessary building permits and schedule required inspections for the project. The client is responsible for providing accurate property information and ensuring access to the job site for inspections. Any costs associated with permits and inspections will be included in the project estimate or billed separately as outlined in the contract.

 

9. Warranty

Dos Bros Construction stands behind the quality of our workmanship. We provide a one (1) year warranty on labor and craftsmanship from the date of project completion, unless otherwise specified in the project contract. This warranty covers defects in workmanship under normal use and conditions.

 

This warranty does not cover: damage caused by the client, third parties, or normal wear and tear; damage resulting from misuse, neglect, or failure to maintain; damage caused by natural disasters, flooding, or other acts of God; materials not supplied by Dos Bros Construction; or cosmetic imperfections that do not affect structural integrity or function.

 

Manufacturer warranties on materials and products are separate and subject to the respective manufacturer’s terms and conditions. Dos Bros Construction will assist clients in processing valid manufacturer warranty claims when applicable.

10. Client Responsibilities

The client agrees to: provide reasonable access to the work site during normal business hours; ensure the work area is accessible and clear of personal belongings prior to the start of work; make timely decisions regarding material selections, design choices, and approvals; communicate any concerns or issues promptly; and make payments according to the agreed-upon payment schedule.

 

The client acknowledges that construction work may involve noise, dust, vibration, and temporary disruption to the property. Dos Bros Construction will take reasonable measures to minimize disruption and will clean the work area upon completion.

11. Insurance and Liability

Dos Bros Construction maintains appropriate insurance coverage, including general liability and workers’ compensation insurance, as required by the State of Colorado. Proof of insurance will be provided upon request.

To the fullest extent permitted by Colorado law, Dos Bros Construction’s liability for any claim arising from or related to our services shall not exceed the total contract price of the project giving rise to the claim. Dos Bros Construction shall not be liable for any indirect, incidental, consequential, or punitive damages.

12. Dispute Resolution

In the event of a dispute arising from or related to these Terms and Conditions or any project contract, both parties agree to first attempt to resolve the matter through good faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, the parties agree to submit to mediation before pursuing any other legal remedy.

 

If mediation is unsuccessful, either party may pursue binding arbitration or litigation in the appropriate courts of Weld County, Colorado. These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Colorado.

 

13. Website Use

The content on the Dos Bros Construction website, including text, images, logos, and design elements, is the property of Dos Bros Construction and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content from our website without prior written consent.

 

Our website may contain links to third-party websites. Dos Bros Construction is not responsible for the content, accuracy, or practices of any third-party sites. The inclusion of any link does not imply endorsement by Dos Bros Construction.

While we strive to keep website content current, Dos Bros Construction makes no warranties regarding the accuracy, completeness, or timeliness of information presented on the website. Photos displayed on our website are representative of our work and may not reflect exact results for every project.

 

14. Privacy

Dos Bros Construction respects your privacy. We will not sell, rent, or share your personal information with third parties except as required by law or as necessary to fulfill our contractual obligations.

 

15. Limitation of Liability

Dos Bros Construction shall not be liable for any damages arising from the use or inability to use our website, reliance on any information provided on our website, or any interruption or error in the website’s operation. This limitation applies to the fullest extent permitted by Colorado law.

 

16. Indemnification

The client agrees to indemnify, defend, and hold harmless Dos Bros Construction, its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney’s fees) arising from the client’s breach of these Terms and Conditions, misuse of our services, or negligent or wrongful acts or omissions.

 

17. Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.

18. Entire Agreement

These Terms and Conditions, together with any project-specific contracts or agreements, constitute the entire agreement between you and Dos Bros Construction. No oral or written representations made prior to or contemporaneous with these terms shall be binding unless expressly incorporated herein.

 

19. Modifications

Dos Bros Construction reserves the right to update or modify these Terms and Conditions at any time without prior notice. Changes will be effective immediately upon posting to our website. Your continued use of our website or services after any modifications constitutes acceptance of the revised terms. We encourage you to review these Terms and Conditions periodically.
